Limited Warranty
First Choice Support warrants that any hardware will be free from defects
in materials and workmanship under normal use and service for a period of two (2) years
from the date of receipt, excluding coaxial cables and fittings. Some states/jurisdictions
do not allow limitations on duration of an implied warranty, so the above limitation
may not apply to you. This warranty is voided if the hardware's serial number or any
identifying marks have been removed. If your hardware needs repair, you must call
419-476-6572 to obtain a return authorization number prior to shipping. No return
shipments will be accepted without a return authorization number on the outside
of the shipment.
Customer Remedies
First Choice Support's entire liability and your exclusive remedy shall be,
at our option, either (A) return of the price paid, or (B) repair or replacement
of the hardware that does not meet this limited warranty and which is returned
to First Choice Support System Corp. This limited warranty is void if failure
of the hardware has resulted from improper installation, vandalism, accident,
abuse, misuse or misapplication. Any replacement hardware will be warranted
for the remainder of the original warranty period or thirty (30) days. whichever
is longer.
No Other Warranties
To the maximum extent pemritted by applicable law, First Choice Support
disclaims all other warranties, either express, implied or statutory,
including, but not limited to implied warranties of merchantability and fitness
for a particular purpose, with regard to any hardware. This limited
warranty gives you specific legal rights. You may have others which vary from
state/jurisdiction to state/jurisdiction.
No Liability for Consequential Damages
To the maximimum extent permitted by applicable law, in no event shall First Choice
Support be liable for any damages whatsoever (including without limitation, special,
incidental, punitive, consequential, or indirect damages for personal injury, loss of
business profits, business interruption, loss of business information or any other
pecuniary loss) arising out of the use of or inability to use this product,
even if First Choice Support has been advised of the possibility of such damages. In any
case, First Choice Support's entire liability under any provision of this agreement
shall be limited to the amount actually paid by you for the hardware. Because
some states/jurisdictions do not allow the exclusion or limitation of liability
for consequential or incidental damages, the above limitation may not apply to you.
Governing Law and General Provisions
This agreement will be governed by the laws in force in the state of Ohio excluding
the application of its conflicts of law rules. This agreement will not be governed
by the United Nations Convention on contracts for the international sale of goods,
the applciation of which is expressly excluded. If any part of this agreement
is found void and unenforceable, that particular provision will be deemed modified
to the extent necessary to make the provision valid and enforceable, and the
remaining provisions will remain in full force and effect. Any revision shall not affect
the validity of the balance of the agreement, which shall remain valid and enforceable
according to its terms. You agree that the hardware will not be shipped, transferred
or exported into any country or used in any manner prohibited by the United States
Export Administration Act or any other export laws, restrictions or regulations. This
agreement and provisions may only be modifed by a writing signed by an authorized
officer of the First Choice Support System Corporation.
